Terms of Service

Draft terms. Operational while we complete counsel review before enterprise sales.

1. Who we are

DMCA Boss (the "Service") is operated jointly by Linxact (Daniel Wolter) and Ivana Flynn ("we", "us"). You can reach us at hello@dmcaboss.com.

2. What you're agreeing to

By creating an account you agree to these Terms and our Privacy Policy. If you use the Service for a company, you confirm you have authority to bind that company.

3. The Service

DMCA Boss aggregates publicly-available DMCA notices from the Lumen database, connects to your Google Search Console (read-only) to identify high-value pages, classifies notices with automated tools, and sends you notifications. It provides templates and AI-assisted drafting for counter-notifications under 17 U.S.C. § 512(g). DMCA Boss is a tooling provider. We do not provide legal advice. Counter-notifications are legal instruments; consult qualified counsel when in doubt.

4. Your obligations

  • Ownership. You warrant that you own or are authorized to monitor every domain you add. We verify ownership via DNS TXT records but remain reliant on your representation.
  • Truthfulness. You warrant that any counter-notification you submit reflects a good-faith belief that the targeted material was removed by mistake or misidentification.
  • Acceptable use. No reverse-engineering, scraping of the Service, or use for automated abuse of DMCA procedures.

5. Pricing and billing

Monitoring is billed at €29 per monitored domain per month via Stripe, using usage-based metering. First three domains are free for 14 days. On-demand expert consultation is €150/hour, charged per session. Charges are non-refundable for the current billing period. You can remove domains at any time and meter events will reflect the change immediately.

See our Privacy Policy for details on what we collect and where it lives. You own your data. You can export or delete it at any time.

7. Third parties

The Service integrates with Stripe (payments), Resend (email), Anthropic (AI drafting), Google (Search Console OAuth), the Lumen Database (notice source), Cloudflare (infrastructure) and Cal.com (expert scheduling). Their terms apply to the portions of the Service they provide.

8. Warranty and liability

The Service is provided "as is." To the maximum extent permitted by law, our aggregate liability is capped at the amount you paid to us in the preceding twelve months. We are not liable for indirect, consequential, or loss-of-revenue damages.

9. Termination

You can cancel anytime from the billing portal. We can suspend accounts that violate these Terms or create legal risk to the Service.

10. Governing law

These Terms are governed by the laws of Malta, where Ivana Flynn is registered (VAT MT25977802). Disputes are subject to the exclusive jurisdiction of Maltese courts, without prejudice to mandatory consumer-protection rules of your country of residence if applicable.

11. Changes

We may update these Terms. Material changes will be notified by email at least 14 days before taking effect.
